Iulian Popescu joined Musat & Asociatii in 2004 and distinguished himself as an experienced and dynamic lawyer being involved in advising clients on a wide variety of projects both in the area of consultancy work and dispute resolution. His broad experience includes advisory work as leading lawyer in large infrastructure projects, being particularly skilled in public acquisitions and PPPs, environmental and natural resources matters, concession law and licensing/regulatory issues. His diverse practice focuses as well on transport law, with particular emphasis on shipping and admiralty.

Additionally, Mr. Popescu is extremely active in the firm’s alternative dispute resolution practice, having a broad experience in the areas of domestic and international arbitration and also commercial mediation. In connection with his key areas of expertise, he has successfully handled international arbitrations included, inter alia, in relation to infrastructure construction contracts (FIDIC), joint venture agreements, retail development agreements, privatization agreements and enforcement of arbitral awards.

His recent ADR practice has focused on effective mediation and advocacy with demonstrated results. Acting as licensed mediator and skilled negotiator and summing–up a strategic practice development and cross–disciplinary involvement, Mr. Popescu has been praised by peers and clients alike as a “problem solver”, capable of facilitating settlements for clients outside the courtroom or boardroom.

  • Petrofac Facilities Management Ltd.(UK), a leading international provider of facilities solutions to the oil & gas production and processing industry, in connection with the negotiation and implementation of a production enhancement services agreement for several oil deposits of OMV Petrom, the largest Romanian oil and gas group.
  • Gabriel Resources (Canada), in relation to the exploration and exploitation of the biggest gold and silver mining site in Europe: Rosia Montana (a mining project regarded as one of the biggest foreign investments in Romania, the value of the direct investment amounting to over USD 2 billion).
  • Sagacarbon SA, a subsidiary of Caisse des Dépôts et Consignations France, in connection with the off–market and regulated transactions in Romania under European Union Emissions Trading Scheme concerning greenhouse gas emission allowances.
  • OZ Minerals on its EUR 200 million attempted acquisition (via privatization) of Cuprumin S.A. (a leading Romanian mining company).
  • Electrolux Romania SA (a subsidiary of AB Electrolux, the largest European household appliances maker), in connection with the environmental liabilities entailed by the sale–purchase of a land property affected by historical contamination.
  • VA Tech Wabag, one of the world's leading companies in the water treatment field, with respect to complex legal matters related to the permitting requirements regarding water waste disposal, further to the acquisition of the operation, maintenance and refurbishment of two water waste treatment plants in Romania.
  • Forsage Holdings Ltd an important investor in green energy projects, in connection with various environmental issues related to the development of a wind farm project in Romania, including providing legal advice for implementing the project, as well as day to day legal assistance.
  • Sometra (a Romanian metallurgic producer part of Mytilineos Holdings), in connection with the temporary suspension of the production activity with due regard to the company's integrated environmental authorization and permitting requirements.
  • Aroma Rise, a leading chemical industry international player specialized in the manufacturing of high value aroma chemicals, with respect to their Romanian chemical plant and especially their compliance with the environmental regulatory framework.
  • Anchor Group, a leading real–estate developer, in relation to environmental related issues concerning the development and operation of various real estate projects, including the requisite permitting, and handling of disputes related to alleged excess of noise, vibration and emission levels, together with the monitoring of the relationship with the competent authorities.
  • A large European property development group, in defending claims with aggregate amount of EUR 12,500,000, in arbitration before the Court of International Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania.
  • C.F.R. (Romanian national railway company), in a complex ICC arbitration concerning the performance of a FIDIC agreement for the modernisation of Timisoara Railway Station (one of the oldest and major rail hubs in Romania).
  • A major property developer in Europe in an ICC arbitration concerning construction and development of a major real estate project, value in excess EUR 60,000,000.
  • A worldwide leading construction group in ICC arbitration proceedings concerning performance of a FIDIC agreement, value in excess of EUR 40,000,000.
  • A leading European energy group in an ICC arbitration concerning contractual performance, claim value in excess of EUR 45,000,000.
  • A Greek group active in the metallurgy sector in an arbitration before ICC Paris with regard to the performance of the obligations undertaken through a privatisation contract of a Romanian company with the aggregate claims amounting to EUR 32,000,000.
  • Romanian Olympic and Sports Committee (COSR) in a complex arbitration deriving from the performance of a construction agreement for the Olympic House.
  • Liebrecht & Wood, in the mediation proceedings concerning a claim related to a design and services agreement for the implementation of the West Park (one of the largest retail parks in Bucharest).
  • Vale (former Companhia Vale Do Rio Doce), a world leader in the iron ore market and a global mining company, in connection with its trade operations through Constanta seaport.
  • Universal Alloy Corporation Europe (UACE) – member of the Swiss group Montana Tech Components AG – on various legal matters related to its facility for production of aluminium components for the aerospace industry located in north western Romania.
